Terms of Service
This is a draft. It hasn't been reviewed by a lawyer yet, and a few details are still being filled in. We'll update this page before Taylr's public launch.
These Terms of Service ("Terms") are an agreement between you and Taylr, a business based in Pennsylvania that is not yet registered as a company ("Taylr", "we", "us", "our"). They cover the Taylr app, the website at https://taylr.pages.dev, Ask Taylr, and anything else we offer under the Taylr name (together, the "Service").
Please read them. By creating an account, starting a free trial, or using the Service, you agree to these Terms, our Privacy Policy, our Health and Safety Disclaimer, and our Subscription, Free Trial and Refund Policy. If you don't agree, don't use the Service.
Section 15 contains an arbitration agreement and class action waiver. It affects how disputes are resolved. You can opt out within 30 days.
1. Who can use Taylr
- You must be at least 18 years old.
- You must be able to form a binding contract where you live.
- You must give us true, current information, including in the health screening. Taylr builds your plan from your answers. Wrong answers can lead to a plan that isn't right for you.
- One person per account. Keep your sign-in details private. You're responsible for activity on your account. Tell us at brandonbarris3@gmail.com if you think someone else has accessed it.
2. What Taylr is, and what it isn't
Taylr is a general fitness and wellness service. It builds a workout plan from what you tell us and adjusts it as you train.
Taylr is not:
- a medical service, a doctor, a physical therapist, or any other licensed health professional;
- a substitute for medical advice, diagnosis or treatment;
- a personal trainer watching you in real time;
- an emergency service. If you have a medical emergency, call 911 or your local emergency number.
Nobody at Taylr is acting as your physician or healthcare provider. Using Taylr does not create a doctor-patient, therapist-patient or trainer-client relationship.
Full details: Health and Safety Disclaimer.
3. How your plan is made
Your plan is generated automatically by software. A rules engine selects exercises, sets, reps and weights from your answers, your workout history and your feedback. Ask Taylr uses artificial intelligence (AI) to explain your plan and suggest changes, which the rules engine checks before anything is applied.
Our workouts and safety rules are based on established training guidelines. During the beta, they have not yet been reviewed by certified personal trainers; that review will happen before public launch. No person reviews each user's individual plan, session or AI response before you see it. Software and AI can make mistakes. You are responsible for deciding whether each exercise, weight and session is right for you.

4. Your health, your choice, your risk
Exercise carries risk, including injury, illness and, rarely, death. By using Taylr, you agree that:
- You use the Service at your own risk and voluntarily take on all risks of exercise, known and unknown.
- We recommend you talk to a doctor before starting any exercise program, especially if you have a health condition, are pregnant or recently gave birth, take medication, are returning from injury, or haven't exercised in a while. Whether you do so is your decision.
- You will stop exercising right away and seek medical help if you feel pain, dizziness, chest pain or pressure, shortness of breath beyond normal effort, or anything that feels wrong.
- You are responsible for your training space, your equipment and how you use it, and for having someone spot you when needed.
- You will not rely on Taylr, Ask Taylr or any content in the Service as medical advice.
5. Free trial and subscription
- Signing up and building your plan is free.
- Your first month of membership is free. You won't be charged during the free trial.
- Unless you cancel before the trial ends, your membership automatically becomes a paid subscription at $9.99 USD per month (plus any applicable tax), billed on the day the trial ends and every month after that, until you cancel.
- You can cancel any time. Cancel at least 24 hours before the trial ends to avoid being charged.
- Payments are non-refundable and all sales are final, except where the law requires otherwise. You may still ask us for a refund, and we'll consider each request.
Full details, including how to cancel: Subscription, Free Trial and Refund Policy.
We may change prices. We'll tell you at least 30 days before a price change affects you, and you can cancel before it does.
6. Your content and feedback
- "Your content" means what you put into Taylr: answers, workout logs, check-ins, messages to Ask Taylr, and feedback.
- You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free license to store, process and use it to run, improve and support the Service, as described in our Privacy Policy. This license ends when you delete your content or account, except for copies we must keep by law or in routine backups for a limited time.
- If you send us ideas or suggestions, we may use them without paying you or owing you anything.
7. Our content and your license to use Taylr
The Service, including the app, software, rules engine, plans, workouts, videos, images, text, the Taylr name and logo, belongs to us or our licensors and is protected by law.
We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial fitness use, as long as you follow these Terms.
8. What you agree not to do
Don't:
- copy, sell, resell, share or publicly show our workouts, videos or other content, except using the Service's own share features;
- give others access to your account or subscription;
- reverse engineer, scrape, or try to extract our source code, rules, models or data;
- try to get around safety features, health screening, usage limits or payment;
- use Ask Taylr to create harmful, illegal, hateful, sexual or harassing content, or to get medical advice;
- interfere with the Service, introduce malware, or access systems you're not allowed to;
- use the Service to break any law or anyone's rights;
- use the Service if you're under 18.
9. Ask Taylr and AI
- Ask Taylr is an AI feature, not a person. It can be wrong, incomplete or out of date.
- Ask Taylr can't change your plan by itself. It suggests changes, and our rules engine checks them.
- Ask Taylr does not give medical advice. If you mention certain health symptoms, it will reply with a set safety message and may pause parts of your plan.
- Don't share information with Ask Taylr that you don't want processed, including other people's personal information. See our Privacy Policy for how messages are handled.
- We may set fair-use limits on Ask Taylr and will tell you what they are.
10. Third-party services
Taylr works with services we don't control, such as Apple, Google, our database host and our AI provider. Your use of them may be covered by their own terms. We're not responsible for them. Links to other websites are for convenience only.
11. Changes to the Service
We're a small, growing company. We may add, change or remove features, workouts or content. If we make a change that materially reduces what you've paid for, we'll tell you, and you can cancel.
12. Ending your account
- You can stop using Taylr and delete your account at any time in Settings → Account → Delete account, or by emailing brandonbarris3@gmail.com. Deleting your account doesn't cancel an Apple subscription; cancel that in your Apple ID settings.
- We may suspend or close your account if you break these Terms, misuse the Service, put yourself or others at risk, or if required by law. Where reasonable, we'll tell you first.
- Sections that by their nature should continue after your account ends will continue (for example, sections 4, 6, 7, 13, 14, 15 and 16).
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and that the Service will be uninterrupted or error-free.
We do not promise any particular result, including weight loss, strength gains, body change, or improvement in any health condition. Results depend on many things we don't control.
Some places don't allow certain warranty exclusions, so some of the above may not apply to you.
14. Limitation of liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service.
- We are not liable for any injury, illness, or other harm resulting from exercise or activity you do with or because of the Service, including any plan, workout, weight, video or Ask Taylr response, except to the extent caused by our gross negligence or willful misconduct.
- Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50 USD.
These limits apply to every theory of liability, even if we were told the damage was possible. Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that can't be limited by law.
Release. To the fullest extent the law allows, you release us and our owners, staff, contractors, trainers, reviewers and partners from claims for injury or harm arising from your exercise or physical activity, except claims for gross negligence or willful misconduct. If you're a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Indemnity. You agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
15. Disputes: informal resolution, arbitration and class action waiver
Talk to us first. Before filing a claim, email brandonbarris3@gmail.com with your name, a description of the issue and what you want. We'll try to resolve it within 60 days.
Binding arbitration. If we can't resolve it, you and we agree that any dispute arising from these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either of us may bring an individual claim in small claims court, and either of us may ask a court to stop infringement of intellectual property. Arbitration will be run by the American Arbitration Association under its consumer rules. The Federal Arbitration Act governs this section.
Class action waiver. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative action.
Opt out. You can opt out of this arbitration agreement by emailing brandonbarris3@gmail.com within 30 days of first accepting these Terms, with your name, account email and a clear statement that you opt out of arbitration.
If this section is found unenforceable, disputes will be resolved in the courts described in section 16.
16. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be heard in the state or federal courts in Chester County, Pennsylvania, and you and we consent to those courts. If you live outside the United States, you may also have rights under the laws where you live that these Terms can't take away.
17. Apple App Store terms
If you got Taylr from the Apple App Store:
- These Terms are between you and us, not Apple. Apple isn't responsible for the app or its content.
- Your license is limited to using the app on Apple devices you own or control, as allowed by the App Store's Usage Rules.
- Apple has no duty to provide maintenance or support for the app.
- If the app fails to meet a warranty that applies, you may tell Apple, and Apple may refund the purchase price of the app (if any). Apple has no other warranty obligation.
- Apple isn't responsible for any claims about the app, including product liability, legal or regulatory compliance, or consumer protection claims. We are, to the extent these Terms don't limit it.
- Apple isn't responsible for investigating or defending a claim that the app infringes someone's intellectual property.
- You confirm you aren't in a country under a U.S. government embargo or on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Copyright complaints
If you believe content in Taylr infringes your copyright, send a notice to brandonbarris3@gmail.com with: your contact details; the work you believe is infringed; where it appears in Taylr; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and you're authorized to act; and your signature.
19. General
- Changes to these Terms. We may update these Terms. If a change is material, we'll tell you in the app or by email at least 30 days before it takes effect. If you keep using Taylr after that, you accept the new Terms. If you don't agree, cancel and stop using the Service.
- Whole agreement. These Terms and the documents they link to are the whole agreement between you and us about the Service.
- Severability. If any part is unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right, we haven't given it up.
- Assignment. You can't transfer these Terms. We may transfer them as part of a merger, sale or reorganization.
- Force majeure. We're not responsible for delays or failures caused by things outside our reasonable control.
- Notices. We'll contact you at your account email or in the app. You can contact us at the address below.
